Although public–private partnerships (PPPs) are frequently analyzed and lauded in terms of efficiency, their impact on public values is often neglected. As a result, there is little empirical evidence supporting or rejecting the claim that PPPs have a negative effect on public values. This case study provides valuable insight into the relationship between public values in PPPs and the circumstances affecting the degree to which public values are upheld. Research findings demonstrate that whether public values are at stake in PPPs cannot be answered with a simple yes or no. Rather, public values can be threatened, safeguarded, or even strengthened depending on the project phase and the specific facet of the public value under scrutiny. Insight into which circumstances influence the safeguarding of public values in DBFMO (design–build–finance–maintain–operate) projects unravels the strengths and weaknesses of PPPs in terms of public values, providing public managers with a starting point for optimization.

L'article examine dans quelle mesure les fonctionnaires néerlandais et espagnols font des compromis entre l'imputabilité des processus et des résultats lors de la conception, de la gestion et de l'adaptation des contrats pour les partenariats public-privé. Nous nous attendons à ce que les traditions administratives distinctes des deux pays (respectivement légaliste et axée sur la gestion) aient une influence. En analysant les contrats, les documents stratégiques et les entretiens menés avec 89 membres de projets néerlandais et espagnols, l'article montre que les administrateurs néerlandais se concentrent sur l'imputabilité des résultats, conformément aux principes de la gouvernance relationnelle, tandis que les responsables espagnols optent pour l'imputabilité des processus, conformément au cadre de gouvernance contractuel pour les services non cliniques, et pour l'imputabilité axée sur les résultats pour les services cliniques dans les hôpitaux. Remarques à l'intention des praticiens L'imputabilité procédurale et l'imputabilité par les résultats ne sont pas nécessairement des substituts. Les pays très légalistes peuvent mettre l'accent sur l'imputabilité des processus, mais l'imputabilité par les résultats est nécessaire pour exploiter le potentiel de l'opérateur du secteur privé qui fournit des services publics. Les contrats à long terme exigent que le maître d'ouvrage fixe d'abord les résultats à atteindre, puis élabore les mécanismes d'imputabilité les plus appropriés. L'imputabilité par les résultats exige des compétences que l'on ne trouve pas facilement dans le secteur public des pays légalistes, ce qui est essentiel pour rendre compte correctement du contrat.

El carácter disruptivo de las redes sociales ha puesto de manifiesto dentro de las Administraciones públicas la necesidad de cambio hacia estructuras más flexibles y abiertas. Este fue, entre otros, el argumento que llevó durante la década anterior a la puesta en marcha de procesos de agencialización en el sector público español. Por ello, cabría esperar que la adopción de este tipo de tecnologías digitales en agencias estatales hubiese generado usos más orientados hacia la transparencia, participación y colaboración. En ese sentido, en este artículo se pretende estudiar hasta qué punto existen diferencias entre organismos públicos estatales y ministerios en relación con su provisión de información pública en Twitter. Para ello, se ha llevado a cabo la monitorización de la actividad de entidades del sector público institucional estatal y de los ministerios a través de la red social Twitter. Los datos han sido analizados a través del empleo de una taxonomía especializada para datos de Twitter. Los resultados muestran una cierta tendencia de los organismos públicos estatales a ser partícipes activos de la difusión de información pública, y de los ministerios a ser objeto pasivo de la difusión.

Les contrats de conception-construction-financement-maintenance-exploitation, sous forme de partenariats public-privé, sont censés offrir des possibilités d'innovation grâce à leur vision à long terme, à l'utilisation de caractéristiques de fonctionnement et à l'environnement de collaboration. La littérature indique que la dynamique entre les acheteurs et les consortiums influence la contribution réelle de ces conditions aux pratiques innovantes. Nous examinons dès lors dans trois cas, aux Pays-Bas et en Espagne, comment et dans quelle mesure la relation entre les acheteurs et les consortiums affecte ces trois conditions et, ainsi, les possibilités d'innovation réelle et de création de valeur économique et sociale. Les résultats indiquent que le potentiel des contrats de conception-construction-financement-maintenance-exploitation pour l'innovation est entravé parce que les acheteurs et les consortiums se comportent comme des mandants et des mandataires qui se méfient les uns des autres et qui laissent les objectifs à court terme intéressés l'emporter sur les objectifs à long terme favorables à l'organisation. Les cas ont montré que la réalisation limitée de l'innovation et la génération d'une valeur inférieure aux attentes semblent être dues à l'absence d'un schéma clair permettant de capter la valeur. Remarques à l'intention des praticiens • L'innovation potentielle dans les contrats de conception-construction-financement-maintenance-exploitation est limitée à la construction de l'infrastructure et aux premières phases opérationnelles du contrat car les clauses de renégociation sont normalement trop rigides. • Un système adéquat permettant de déterminer les risques financiers qui créent une valeur économique pour le contractant est nécessaire pour produire une valeur sociale par l'innovation. • Le contrat doit établir un programme de collaboration « contraignant » entre les membres du consortium pour récolter les bénéfices de l'innovation.
El objetivo de este artículo es profundizar en las explicaciones sobre la emergencia de nuevos partidos. En concreto, se estudia qué cuestiones han sido centrales en los discursos de las nuevas formaciones y hasta qué punto dichos temas 1) son demandas de la sociedad (demand syde) y 2) ya habían sido abordados por los partidos establecidos (supply syde). Para ello, utilizando los casos de España y los Países Bajos, analizamos los programas electorales de las nuevas formaciones políticas, identificamos los temas principales de su discurso, con encuestas de opinión vemos las principales preocupaciones de españoles y holandeses y, gracias al Comparative Manifestos Project, comprobamos hasta qué punto estos temas no habían sido abordados previamente por las fuerzas tradicionales. Nuestros resultados muestran que, mientras que en los Países Bajos los temas de los nuevos partidos apenas son nombrados por las formaciones tradicionales, en España los asuntos centrales son compartidos por todas las formaciones, y los partidos emergentes surgen debido a los sentimientos de desconfianza hacia los que ya estaban establecido ; The objective of this article is to shed light on explanations for the emergence of new parties. In particular, it examines which issues have been central to the discourses of these new formations and to what extent 1) these issues are relevant for the electors (demand side) and 2) have been addressed by already established parties (supply side). Using the cases of Spain and the Netherlands, we analyse the electoral programmes of the new parties, identify the main themes of their discourse and assess the main concerns for electors from Spain and the Netherlands based on opinion polls. Moreover, thanks to the Comparative Manifestos Project, we check to what extent these issues were not previously included in the manifestos of the established parties. Our results show that while the themes of new parties are scarcely named by traditional parties in the Netherlands, central issues are shared by all political formations in Spain, and new parties emerge due to feelings of distrust towards established ones

The article examines to what extent Dutch and Spanish officials make trade-offs between process and result accountability during the design, management and adaptation of contracts for public–private partnerships. The countries' distinct administrative traditions (legalistic versus managerial-oriented, respectively) are expected to be influential. Analysing contracts, policy documents and interviews with 89 Dutch and Spanish project members, the article shows that Dutch administrators focus on outcome accountability, following the tenets of relational governance, whereas Spanish officials opt for process accountability in line with the contractual governance framework in non-clinical services, and for result accountability for clinical services in hospitals. Points for practitioners • Procedural and results-based accountability are not necessarily alternatives. High legalistic countries may emphasize process accountability but results-based accountability is needed to realize the potential from the private-sector operator delivering public services. • Long-term contracts require that the procurer first sets the results to be achieved and then work out the more suitable accountability mechanisms. • Results-based accountability requires competencies that are not easily found in the public sector of legalistic countries and this is key for properly giving account of the contract.

Design–Build–Finance–Maintain–Operate contracts, as a specific public–private partnership, supposedly provide opportunities for innovation due to the long-term perspective, the use of output specifications and the collaborative environment. The literature suggests that the dynamics between procurers and consortia influence the actual contribution of these conditions to innovative practices. We therefore assess in three cases in the Netherlands and Spain how and to what extent the relationship between procurers and consortia affect these three conditions and therewith the possibilities for realising innovation and for capturing economic and social value. Findings show that the potential of Design–Build–Finance–Maintain–Operate contracts for innovation is hampered because procurers and consortia behave like principals and agents who distrust each other and who let short-term self-interested goals prevail over long-term pro-organisational goals. The cases have shown that the limited realisation of innovation and less-than-expected value generation seem to be due to the absence of a clear scheme that allows for capturing value. Points for practitioners • Potential innovation in Design–Build–Finance–Maintain–Operate contracts is restricted to the building of the infrastructure and the early operational phases of the contract because renegotiation clauses are normally too rigid. • An adequate system to work out financial risks that create economic value for the contractor are needed to produce social value through innovation. • The contract needs to work out a 'binding' collaboration scheme among the consortium members to reap the benefits of innovation.

AbstractDesign‐Build‐Finance‐Maintain‐Operate (DBFMO) contracts are a particular type of public‐private partnership whereby governments transfer the responsibility for the design, construction, financing, maintenance, and operation of a public infrastructure or utility service building to a multi‐headed private consortium through a long‐term performance contract. These arrangements present a typical principal‐agent problem because they incorporate a "carrot and stick" approach in which the agent (consortium) has to fulfill the expectations of the principal (procurer). This article deals with a neglected aspect in the literature related to the actual use of "the sticks or sanctions" in DBFMOs and assesses to what extent and under which conditions contract managers adopt a deterrence‐based enforcement approach or switch to a persuasion‐based approach, specifically when the contract clauses require the use of (automatic) deterrence. An empirical analysis of four DBFMOs in the Netherlands shows that the continuation of service delivery, the need to build trust, and the lack of agreement on output specifications play a role in the willingness of the procurer to apply a more responsive behavior that uses persuasion, even when deterrence should be automatically applied. © 2016 John Wiley & Sons Australia, Ltd
